By submitting a video to CW23 WNLO / WIVB and thnkb4ytxt.com in conjunction with this contest, and in consideration for receiving the opportunity to have the video considered for airing on WIVB and/or CW23 and/or on thnkb4utxt.com, participant acknowledges, understands, and agrees to the website terms of service and the official contest rules.

1. HOW TO ENTER

a. The THNKB4UTXT video contest will begin on January 13, 2012 and run through May 1, 2012.

b. To participate in the contest, you may enter via the following web page: www.thnkb4utxt.com and click on the THNKB4UTXT contest link to upload your video and fill out the entry form. Incomplete entries will not be eligible to win.

c. The Station is not responsible for Internet transmission errors, illegible entries, service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent transmitting his/her entry.

d. All entries become the property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into regarding the status of any entry.

2. ELIGIBILITY RESTRICTIONS

a. The contest is open to legal residents of the U.S. who are 13 years or older at the time of entry, who are residents of Erie, Genesee, Niagara, Orleans, Wyoming, Chautauqua, Cattaraugus, or Allegany counties. Employees, officers, and directors (and members of the immediate families or households of each) of WIVB-TV and each of their respective affiliated companies, subsidiaries, distributors, printers and advertising and promotion agencies, and any and all other companies associated with this contest, are not eligible to participate. Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

b. I acknowledge that I have read and accept the contest rules and agree to comply with rule requirements of the contest. I hereby release full rights to my photo, including use of my name in connection therewith, to use, exhibit, print, or publish for news, advertising purposes, or otherwise for immediate release without prior inspection by me. I further certify that this is an original video, taken by me, and I have permission to use the image of any person appearing in said video. If the entrant or any participant in a video is a minor, this certification must be made by a parent or legal guardian. Videos cannot contain nudity, hate speech or other inappropriate content solely in the discretion of the station. Participants video submission may not include logos, pictures, or any type of non-original music, or other intellectual property without the permission of the rights holder.

c. Only one winner per household is permitted in any Station contest.

3. PRIZES

a. WIVB-TV will select multiple anti-texting and driving video messages from the submitted contest entries as finalists. Selected video entries will appear on News 4’s Wake Up. Of those selected for airing, the four (4) best videos (determined by News 4 management) will each receive a gift certificate for a two hour party at Oogie Games approximate value $150 each. Prize gift certificates provided by Oogie Games and presented to winners by WIVB.

b. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Winners will be selected based upon creativity and suitability by a panel of station judges. Decisions of station management with respect to the contest are final.

b. Selected Winners of the Oogie Games prize will be notified by station representative by e-mail.

c. Odds of winning depend on the number of entries received.

d. Winner(s) list will be available at www.thnkb4utxt.com.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b. By participating in the contest, entrants agree to have their video, their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize, the Station in its sole discretion may require contest winners to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

d. The Station and the sponsor reserve the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

e. Failure to comply with the contest rules or the Station’s website Terms of Service may result in an entrant’s disqualification solely at the discretion of the Station.

f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
